1. Acceptance of terms
By accessing this website or engaging our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the website or book our services.
2. Our services
Maisha Masha Safaris provides full-service tour and travel experiences in Kenya, including airport transfers, accommodation booking, transport, guided safaris, cultural experiences and itinerary planning. We act as an organiser, arranging services provided by third parties (hotels, lodges, transport and guides).
3. Bookings and confirmation
- Submitting a booking enquiry on this website does not create a binding contract. A booking is confirmed only when we issue a written confirmation (and, where applicable, a deposit is received).
- Quotes are subject to availability and may change until your booking is confirmed.
4. Pricing and payment
Prices are displayed in US Dollars and, for local visitors, in Kenyan Shillings at the prevailing exchange rate shown on the website. Payment terms (deposit and balance) are stated in your booking agreement. Payment methods are confirmed at the time of booking.
5. Your responsibilities
It is your responsibility to ensure that:
- You hold valid travel documents, passports and any required visas or electronic travel authorisation (eTA) for Kenya.
- You meet any health requirements, including vaccinations (such as yellow fever) and carry recommended travel insurance.
- You provide accurate information about travellers, dates and any special requirements.
We strongly recommend comprehensive travel insurance covering trip cancellation, medical expenses, evacuation and personal effects.
6. Cancellations and changes
Cancellations and amendments are governed by our Refund & Cancellation Policy, which forms part of these Terms.
7. Liability and disclaimer
We take every reasonable care to deliver a safe and enjoyable experience using licensed guides and vetted partners. However, safaris and travel inherently involve some risk, including wildlife and road travel. To the fullest extent permitted by law, Maisha Masha Safaris shall not be liable for loss, injury or damage arising from events beyond our reasonable control, or from the acts or omissions of third-party providers, except where caused by our gross negligence or wilful misconduct.
Information on this website is provided for general guidance. While we strive for accuracy, details of destinations, prices and availability may change without notice.
8. Force majeure
We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, epidemic or pandemic restrictions, civil unrest, strikes or travel bans.
9. Intellectual property
All content on this website, including text, images, graphics and logos, is owned by or licensed to Maisha Masha Safaris and is protected by applicable intellectual property laws. You may not reproduce or use it without our prior written consent.
10. Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from them shall be subject to the exclusive jurisdiction of the courts of Kenya, save that we will first seek to resolve any complaint amicably.
